Apprehending arrest, the original accused Nos. 2 and 3 have approached this Court, in connection with Crime No. 371 of 2024, registered with Police Station Tamgaon, District Buldhana, for offences punishable under Sections 108, 115(2), 3(5), 352 of the Bharatiya Nyaya Sanhita, 2023.

The informant of crime is one Kisan Chandrabhan Ratale, on whose complaint, the FIR was lodged.

According to the investigating agency deceased was one Prameshwar Kisan Ratale. The Applicant no. 1 named Chanda is his wife and applicant no. 2 named Uma is mother-in-law of deceased.

In short, it is the case of the prosecution that marriage of deceased Parmeshwar was solemnized with

2 19aba313.2026.odt one Chanda in the year 2022. The paternal house of Chanda was at village Pesoda. The FIR shows that Chanda, after marriage was insisting Parmeshwar to reside with her parents. Though, the deceased was not interested, it was due to her insistence, deceased stayed there. According to FIR, on several occasions, he was humiliated and abused by the applicants and other accused. Specific incidence of 11.11.2024 is narrated in the FIR, in which Parmeshwar was abused, assaulted and humiliated. In fact, it was also asked to Parmeshwar as to why he does not commit the suicide. According to FIR, it is due to this continuous harassment and abuses, given by the applicants on 11.11.2024, Parmeshar consumed poison and committed suicide. The incident triggered in registration of FIR dated 4.12.2024.

In this background, the learned counsel for the applicants have contended that, prima-facie, the alleged offences are not made out against the applicants. It was argued that the applicants have attended the concerned police station pursuant to this Court's order dated 21/04/2026.

The learned APP has submitted that though the applicants have attended the concerned police station, they have not cooperated the investigating agency, consequently, he prayed for rejection of the anticipatory bail application.

With the assistance of the respective counsels, I

3 19aba313.2026.odt have gone through the record of the case, which shows that said Parmeshwar was continuously abused and humiliated by the applicants and co-accused, and due to the same, he committed the suicide. Prima-facie, it can be said that the prosecution has not brought anything on record to show that the applicants have abetted the suicide. In view of the aforesaid discussion, and since the applicants have attended the concerned police station, the following order is passed.

ORDER

a) The criminal application is allowed b) In the event of arrest in connection with Crime No. 371/2024, registered with Police Station Tamgaon, District Buldhana, for offences punishable under Sections 108, 115(2), 3(5), 352 of the Bharatiya Nyaya Sanhita, 2023, the applicants (1) Chanda Parmeshwar Ratale (2) Uma Supada Pakhare, be released on bail on furnishing a P.R. bond of Rs. 25,000/- (Rupees Twenty Five Thousand only) each with one solvent surety in the like amount.

c) The applicants shall attend the concerned Police Station as and when required.

d) The applicants shall not tamper with the prosecution evidence or threaten the prosecution witnesses.
