Apprehending arrest the applicant-accused has preferred anticipatory bail application in connection with Crime No.0024/2025, dated 12.03.2025 registered with Police Station, Nagpur City, District-Nagpur for the offences punishable under Sections 66 (C) of the Information Technology Act, 2000 and 340(2), 340(1), 338, 336(3), 319(2) and 318(4) of the Bharatiya Nyaya Sanhita, 2023.

The applicant, who was not named in the First Information Report, claims to be the Headmistress of Rohan Upper Primary School, situated at Timki, Nagpur. 3.

The learned counsel for the applicant has contended that similarly circumstanced accused are already granted anticipatory bail in Criminal Application (ABA) No.48/2026, dated 20.04.2026 and, therefore, the same benefit be extended to the applicant.

The learned APP seeks time to file reply.

In view of order passed by this court on 20.04.2026, till filing of the reply, the following order is passed :

O R D E R

(i) In the event of arrest in connection with Crime No.0024/2025, dated 12.03.2025 registered with Police Station, Nagpur City, District-Nagpur for the offences punishable under Sections 66 (C) of the Information Technology Act, 2000 and 340(2), 340(1), 338, 336(3), 319(2) and 318(4) of the Bharatiya Nyaya Sanhita, 2023, the Applicant-Usha w/o Sanjay Ghatate be released on ad-interim anticipatory bail on furnishing a P.R. Bond of Rs.25,000/- (Rupees : Twenty Five Thousand only) with one solvent surety in the like amount.

(ii) The applicant shall attend the concerned Police Station on 27.4.2026 between 3.00 pm to 6.00 pm. (iii) The applicant shall cooperate with the investigating agency and shall not tamper with the prosecution evidence or influence the witnesses directly or indirectly. (iv) The applicant shall not leave India without prior permission of this court.

(v) Issue notice to the non-applicant, returnable on 30.04.2026.
