This is an application for Anticipatory Bail. 2.

The applicant is apprehending his arrest in Crime No. 712 of 2024 registered at Goregaon Police Station, for the offences punishable under Sections 406 & 420 read with 34 of the Indian Penal Code.

It is the case of the prosecution that the present applicant and other co-accused defrauded the first informant to the tune of Rs.20,00,000/- on the pretext of granting exclusive rights of catering and decoration in the banquet hall owned by them.

I have heard the learned counsel for the applicant and the learned APP for the respondent-State.

The learned counsel for the applicant submits that the dispute between the parties, if any, is of civil nature. It is submitted that there is no need of custodial interrogation and the applicant is ready and willing to co-operate in the investigation. 6.

On the other hand, the learned APP for the respondentState submits that the applicant is involved in one more crime of similar nature. It is submitted that the applicant had issued the cheque for refund of the amount however that also got dishonored. It is submitted that thus the applicant may not be released on anticipatory bail.

I have perused the first information report and the documents on record. Prima-facie, the dispute between the parties appears to be of a civil nature. In that view of the matter, I am inclined to release the applicant on anticipatory bail. In the result, the following order is passed :

a) The Application is allowed.

b) In the event of arrest of the applicant in connection with Crime No. 712 of 2024 registered at Goregaon Police Station, for the offences punishable under Sections 406 & 420 read with 34 of the Indian Penal Code, the applicant be released on bail on furnishing P.R. Bond in the sum of Rs. 25,000/- with one or two sureties in the like amount.

c) The applicant shall attend the concerned police station as and when called by the investigating officer and shall co-operate in the investigation.
