DATED : 29/04/2026 Apprehending arrest, the applicant/accused has preferred this application in connection with Crime No. 0107/2026, dated 31/03/2026, registered with Police Station Jalamb, Tq. Shegaon, District Buldhana for the offence punishable under Section 137 (2) of the Bharatiya Nyaya Sanhita, 2023.

The informant of the crime is father of the victim. The victim is a girl aged 15 years and 9 months and, at the relevant time, was studying in 10th standard. In short, it is alleged in the FIR that one Mayur Gajanan Nagolkar informed the complainant telephonically that his brother-in-law, namely Vaibhav Dilip Ugale, had abducted the victim of the crime and the accused along with the victim would be going to Washim. On the basis of this information, the First Information Report came to be lodged.

The learned counsel for the applicant submits
2 1aba336.2026.odt that applicant is 18 years and 5 months. During the course of investigation, Sections 74, 75(1) of Bharatiya Nyaya Sanhita, 2023, as well as Section 8 of the Protection of Children from Sexual Offences Act, 2012, came to be added against the applicant, on the basis of the statement made by victim alleging that the applicant had outraged her modesty.

The learned APP has opposed the application and contended that the victim was a minor in the eyes of law and therefore, prima-facie case is made out against the applicant.

Considering the fact that applicant is student and there is close proximity in age of the applicant and the victim, till reply is filed, I am inclined to protect liberty of applicant. Hence, the following order.
ORDER
a) Issue notice to the non-applicants, returnable on 06/05/2026 b) The learned APP waives service of notice on behalf of the non-applicant/ State.
c) In the event of arrest, in connection with Crime No. 0107/2026, dated 31/03/2026, registered with Police Station Jalamb, Tq. Shegaon, District Buldhana for the offence punishable under Section 137 (2) of the Bharatiya Nyaya Sanhita, 2023, the applicant
3 1aba336.2026.odt Vaibhav s/o Dilip Ugle, be released on ad-interim anticipatory bail on furnishing a P.R. bond of Rs. 25,000/- (Rupees Twenty Five Thousand Only) with one solvent surety in the like amount.
d) The applicant shall attend the concerned Police Station on 2nd and 3rd May 2026, between 10.00 a.m. to 12.00 noon.
e) The applicant shall cooperate with the investigating agency and shall not tamper with the prosecution evidence or influence the witnesses.
f) The applicant shall not leave the India without prior permission of the Court.
