Apprehending arrest in connection with Crime No.254/2026 dated 13.03.2026 registered with Police Station Barshitakli, Dist Akola, for the offences punishable under Sections 118(1), 118(2), 189(2), 190, 191(2), 191(3), and 351(2) of Bharatiya Nyaya Sanhita, 2023, the applicants (five persons) have approached this Court. 2.
The First Information Report in question was lodged at the instance of one Ankush Vishnu Ingle. In short, it was alleged in the FIR that quarrel had taken place with the informant party on the reason of right to way and on that count a free-fight took place. It was alleged that the present applicants, forming unlawful assembly, had assaulted the informant party.

The learned counsel for the applicants submitted that even the accused persons named in the FIR, more particularly Suryabhan Ingle, had lodged the FIR against the
informant party. He therefore prayed for ad interim anticipatory bail.

Per contra, the learned APP has opposed the application on the ground that specific role assigned to the applicants and sought time to file reply.

The learned counsel for the applicants has submitted that after rejecting their application for anticipatory bail, the Sessions Court on subsequent date has extended ad interim anticipatory bail granted to the applicants for 15 days, which period will come to end on 01.05.2026.

Considering the fact that there are counter-cases and few of the accused are already granted anticipatory bail qua the informant party, till filing the reply the liberty of the applicants can be protected. Hence, the following order is passed:
ORDER
(i) Issue notice to the non-applicant, returnable on 05.05.2026.
(ii) The learned APP waives service of notice for nonapplicant State and prays for time to file reply. (iii) In the event of arrest in connection with Crime No.254/2026 dated 13.03.2026 registered with Police Station Barshitakli, Dist Akola, for the offences punishable
under Sections 118(1), 118(2), 189(2), 190, 191(2), 191(3) and 351(2) of Bharatiya Nyaya Sanhita, 2023, applicants -
(1) Gajanan Baban Ingle, (2) Suryabhan Baban Ingle, (3) Bhimrao Omkar Ingle, (4) Vishwambar Omkar Ingle and (5) Sachin Bhimrao Ingle shall be released on ad interim bail on furnishing a PR bond of 25,000/- [Rupees Twenty Five ₹ Thousand only] each with one solvent surety each in the like amount.
(iii) The applicants shall attend the concerned Police Station on 2nd and 3rd May 2026 between 03:00 pm to 06:00 pm.
(iv) The applicants shall cooperate with the investigating agency and shall not tamper with the prosecution evidence or influence the witnesses directly or indirectly. (v) The applicants shall not leave India without prior permission of this Court.
