In anticipation of arrest in Crime No.293/2026 registered with Dahihanda Police Station, Akola for the offence punishable under Sections 74, 333, 351(2), 351(3) of the Bharatiya Nyaya Sanhita, 2023, the applicant is prayed for pre-arrest protection.

This Court has issued notices to the nonapplicants, in response to which the non-applicant no.1 State has already filed a reply. So this application can be heard and decided finally after hearing both the parties on 08.06.2026. However, perusal of the reply of the State filed before the learned Sessions Court and the reply filed before this Court revealed that the Investigating Officer has nothing to recover from the applicant for which the custody is said to be required. 2 18.aba.350.2026 submits that the applicant runs a Setu Centre and therefore, in view of on going academic activities and further requirement of various certificates pertaining to the caste and income of the student, the applicant needs to be protected to run the said Setu Centre which is situated in the Akot City, Tq. Akot, District Akola. It is also submitted that the complainant is residing at village Rel, Taluka Akot, District Akola and therefore, if the applicant is released on anticipatory bail, he will not enter into the jurisdiction of the Dahihanda Police Station.

In view of the above facts and circumstances of the case, I am inclined to release the present applicant on adinterim anticipatory bail till the next date of hearing i.e. 08.06.2026. Hence the following order :
(a) In the event of arrest applicant Shubham s/o Madhukar Lone in Crime No.293/2026 registered with Dahihanda Police Station, Akola for the offence punishable under Sections 74, 333, 351(2), 351(3) of the Bharatiya Nyaya Sanhita, 2023 be released on ad-interim anticipatory bail till 08.06.2026 on his furnishing P.R. bond of Rs.50,000/- with one solvent surety in the like amount.
(b) The Applicant shall attend concerned Police Station on every Tuesday and Friday in between 1.00 pm to 4.00 pm to facilitate the investigation till 08.06.2026.
(c) Apart from attendance of police station, the
3 18.aba.350.2026 applicant shall not enter into the jurisdiction of Police Station Dahihanda, Tq. Akot, District Akola and more specifically in village Rel, Tq. Akot, District Akola.
(d) The Applicant/Accused shall co-operate with the Investigating Agency.
(e) The Applicant/accused shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also shall not tamper with the evidence.
(f) The Applicant/accused shall provide his residential address and cell number to the concerned Investigating Officer where they intend to reside.
(g) Breach of either of condition would give rise to the prosecution to move this Court for cancellation of bail.
