Apprehending arrest in connection with Crime No. 322 of 2025 dated 29/07/2025 registered with Police Station Daryapur, District Amravati, for the offence punishable under Section 420 and 417 of the Indian Penal Code, 1860, the applicant, who was not named in the FIR, has approached this Court.

The FIR was lodged by one Ananta Dadarao Mahalle against one Sanjay Kulkarni.

In short, it is alleged in the FIR that the principal accused Sanjay Kulkarni, had met the informant and assured him that he would provide a Government Job to the informant as he was having close relations with the Chief Minister and Deputy Chief Minister. He also showed his photographs with Chief Minister of Maharashtra.

It is alleged in the FIR that accused Sanjay Kulkarni then informed the informant that recruitment for the post of Talathi would be conducted in the year 2023 and therefore, asked him to submit a form for the same. The said Sanjay Kulkarni demanded an amount of Rs.20,00,000/- along with signed blank stamp papers. It was further alleged that from one Ashish Dhumale was also demanded an amount of Rs.15,00,000/- for giving appointment on the post of Gram Sevak. Blank signed cheques and the stamp papers were also demanded from Ashish Dhumale. On the basis of it, the informant and the said Ashish had given the blank stamp papers and the cheques to said Sanjay Kulkarni. According to the FIR, thereafter, on 25/07/2023 and on different dates, both of them had given an amount of Rs. 8,50,000/- to the said Sanjay Kulkarni. It is alleged that on 09/04/2024 the informant appeared for the Talathi examination, the result of which was declared on 21/03/2024.

According to the FIR, when the accused Sanjay Kulkarni was contacted by the informant, he told that the name of the informant had appeared in waiting list and forwarded a list of the candidates to the informant's e-mail, which revealed that the name of informant was at Sr. No. 40.

According to the FIR, when informant inquired about the waiting list, he came to know that the said list was bogus. In the said list, the name of Ashish Dhumale was not shown and therefore, when the said Sanjay

3 25aba371.2026.odt Kulkarni was questioned, he did not respond. On further inquiry, the informant came to know that the said Sanjay Kulkarni had cheated several persons on similar grounds. The informant initially approached the Crime Branch, Amravati, and consequently the FIR came to be registered. 8.

The learned counsel for the applicant has contended that he was not named in FIR and there are absolutely no allegations against him. He further argued that the applicant is not at all involved in the crime and he is innocent.

Per contra, the learned APP has contended that the name of the applicant has surfaced during the course of investigation. The statements of Laxman, Nitin, and Hemant clearly shows that co-accused Shrikant had introduced the applicant to several other persons by stating that he would provide them employment. 10.

The learned APP has also contended that the applicant has criminal antecedents of a similar nature. 11.

With the assistance of the respective counsels, I have gone through the record of the case. Though in the FIR the name of the applicant is not reflected, it is during the course of investigation his name has surfaced as an accused. The statements of the witnesses stated above show that the applicant had also participated in the commission of offence. The investigation of the crime is at a preliminary stage, it cannot be ignored that applicant has similar type of criminal cases registered against him. The

4 25aba371.2026.odt tendency to commit to similar types of crime is thus crystal clear.

In that view of the matter, I do not find any merit in the present application. Hence, the criminal application is rejected.
