By this application, the applicant, who is the mother-inlaw of the deceased, approached before this court apprehending the arrest in connection with Crime No.0940/2026 registered with Police Station, Khadan, District-Akola for the offence punishable under Sections 108, 3(5), 80(1)(2) and 85 of the Bharatiya Nyaya Sanhita, 2023.

The perusal of the complaint lodged by the informant in the matter clarify the fact that the deceased has committed suicide and before committing the suicide, there was a call to her from the deceased stating that her husband Ajay is having a suspicion that she is having illicit relations with some person of other community and immediately thereafter the phone was switched off and, thereafter, her body was found on Railway Station, Badnera.

From the averment in the complaint, it is clear that the main allegations are made against the accused no.1 i.e. husband Ajay. There are no specific allegation against the present applicant in the matter. So also, no offence is specifically made out under
2 18 ABA 395.26.odt Section 108 of the BNS, 2023 by considering the statement of the present informant in the matter. In respect of other offences, all allegations are vague in nature. In the circumstances, the applicant has stated that it is a fit case for grant of anticipatory bail.

The learned APP has strongly opposed the present application. According to him, considering the allegations detail enquiry is required and for that purpose the custody of the present applicant is necessary and, therefore, he requested to reject the application of the present applicant. 5.
In the light of the averment in the complaint made by the informant and the fact that the allegations against the present applicant are vague in nature, the applicant is entitled for anticipatory bail in the facts and circumstances of the matter. The custody of the applicant is not at all necessary. At the most, she can be directed to attend the Police Station, if so required by the Investigation Officer. In view of above, the following order is passed :
O R D E R
(i) The application is allowed.
(ii) In the event of arrest in connection with Crime No.0940/2026 registered with Police Station, Khadan, DistrictAkola for the offence punishable under Sections 108, 3(5), 80(1) (2), 85 of the Bharatiya Nyaya Sanhita, 2023, the applicant - Ushadevi Ratanlal Chitlangiya be released on bail on executing P.R. Bond in the sum of Rs.25,000/- with one solvent surety in the like amount.
(iii) The applicant shall attend the concerned Police Station as and when called by the Investigation Officer. The
3 18 ABA 395.26.odt Investigation Officer shall call the applicant by giving due notice to the applicant in the matter.
(iv) The applicant shall, at the time of execution of bond, furnish her address and telephone/mobile number (s), to the investigating officer and the court concerned, and shall not change the same till the final disposal of the case. (v) The applicant shall not directly or indirectly make any inducement, threat or promise to any witness acquainted with the facts of the case so as to dissuade her from disclosing such facts to the court or any Police Officer. (vi) The applicant shall not obstruct or hamper the police investigation and not play mischief with the evidence collected or yet to be collected by the investigating officer. 6.
