This is an application for Anticipatory Bail. 2.
The applicant is apprehending his arrest in Crime No. 649 of 2025 registered at Chembur Police Station, for the offences punishable under Sections 318(4), 336(3), 338 & 340 of the Bharatiya Nyaya Sanhita, 2023.

I have heard the learned counsel for the applicant and the learned APP for the respondent-State.

On 13.02.2026 this Court passed the following order : 1/3

The bus owned by the present applicant was intercepted and the engine number and chassis number of the said vehicle were found to be tampered.

The learned counsel for the applicant submits that the applicant is the bonafide purchaser of the vehicle in question. It is submitted that the applicant has purchased the vehicle in question through the agent, Amjad Ali. It is submitted that the applicant has paid an amount of Rs.13 lakhs for purchasing the said vehicle. The learned counsel for the applicant submits that the applicant is ready and willing to co-operate in the investigation.

The learned APP seeks time. At his request list on 04.03.2026.

Till the next date, the applicant shall not be arrested.

In the meantime, the applicant shall attend the concerned police station on 23.02.2026 and 24.02.2026 between 11.00 a.m. and 2.00 p.m. and shall co-operate in the investigation.

The learned APP, on instructions, submits that pursuant to the above order, the applicant had attended the concerned police station and co-operated in the investigation. It is submitted that custodial interrogation of the applicant is not necessary. 2/3

In that view of the matter, I am inclined to release the applicant on anticipatory bail. In the result, the following order is passed :
O R D E R
a) The Application is allowed.
b) In the event of arrest of the applicant in connection with Crime No. 649 of 2025 registered at Chembur Police Station, for the offences punishable under Sections 318(4), 336(3), 338 & 340 of the Bharatiya Nyaya Sanhita, 2023, the applicant be released on bail on furnishing P.R. Bond in the sum of Rs. 25,000/- with one or two sureties in the like amount.
c) The applicant shall attend the concerned police station as and when called by the investigating officer for the purpose of investigation, if any.
