This Court on 26th May, 2026 has specifically recorded in para 3 and 4 as under :

"3. The learned counsel for the applicant has invited my attention to the recitals of the FIR, wherein the main allegation is against Accused No.1, the President, and Accused No.2, the Manager, who is the son of Accused No.1, the President. Mr. Dhore, the learned counsel for the applicant, submits that the applicant was a nominal director in the aforesaid Samarth Nagri Sahakari Patsanstha, Shegaon. He has also invited my attention to the agreement dated 09.06.2024, which is at record Page No.41 (Annexure 3), executed between the present applicant and Accused No.2, Shashikant Rambhau Gote, wherein it has been admitted by Accused No.2 that the applicant is a nominal director without any financial powers. Mr. Dhore has also pointed out the resignation dated 07.03.2024, which is at record Page No.51 (Annexure 5), thereby tendering his resignation as Director from the Executive Body of the aforesaid society.

The aforesaid resignation was,

12-aba420.26.odt 2/2 however, forwarded by the Assistant Registrar, Co-operative Societies, Shegaon, on 28.06.2024 to the President of the aforesaid Society for necessary action. Such resignation is much prior to the registration of the offence. It is pertinent to note that one Dipak Ganpat Thakare, who is Accused No.8 and is similarly situated to the present applicant, has already been granted anticipatory bail by the learned Sessions Court vide order dated 22.05.2026, which is at record Page No.78 (Annexure 8)."

Today, when the matter is listed for final hearing, learned A.P.P. has pointed out that only for the purpose to get the details of the relevant documents and to disclose money trend and to know about the role played by the other accused persons the custody of the present applicant is required in the matter.

Learned A.P.P. in his reply do not dispute the fact that the present applicant has already resigned from the post of a Director on 7.3.2024 and as a result he is not attending the meetings which are taken place before the registration of the offence.

For the reasons recorded in the order dated 26th May, 2026 I am inclined to allow the present application. Accordingly, the criminal application is allowed on the same terms and conditions recorded in the order dated 26th May, 2026.

Application is disposed of.
