The applicant is a Government Officer and is designated as State Tax Inspector posted with the Goods and Services Tax Department, Kolhapur. He was promoted and in pursuance thereof he is undergoing training at Vanamati, Training Institute, Dharampeth, Nagpur.

The applicant apprehends his arrest in connection with Crime No.241/2026 registered with Police Station Hatkanangale, District Kolhapur for offence under Sections 108, 85 and 80 read with Section 3(5) of Bharaitya Nyaya Sanhita, 2023. 4.

Shri Aniket Rangari, learned counsel for the applicant has invited my attention to the recitals of the FIR lodged by the father of the deceased Rutuja. The marriage of Rutuja was performed with the brother of the applicant viz. Vishal Shrikant Palkhe. The recitals of FIR so far as they pertain to the applicant allege that the

2 ABA-439-26.odt applicant has prohibited the deceased from doing job and using mobile phone. The contention is that this is the only overt act attributed to the present applicant which according to the complainant has led Rutuja to commit suicide. 5.

Shri Rangari, learned counsel submits that the applicant is aware that the offence is registered with Police Station Hatkanangale, District Kolhapur which does not come under the jurisdiction of this Court neither the Sessions Court at Nagpur and accordingly he seeks transit bail for approaching the competent Sessions Court in District Kolhapur for grant of anticipatory bail. 6.

It is submitted that respondent No.2 is insisting upon the applicant to attend the police station and thus the applicant is apprehending his arrest.

In view of the above, I am inclined to grant protection to the applicant till he appears before the competent Sessions Court for seeking grant of anticipatory bail and accordingly, I pass the following order :

(a) In the event of arrest of applicant Harshal s/o Shrikant Palkhe in connection with Crime No.241/2026 registered with Police Station Hatkanangale, District Kolhapur for offence under Sections 108, 85 and 80 read with Section 3(5) of Bharaitya Nyaya Sanhita, 2023, he be released on adinterim anticipatory bail on his furnishing P. R. bond of Rs.50,000/- (Rupees Fifty Thousand) with one solvent surety in the like amount.

(b) The aforesaid ad-interim bail shall remain in effect till 08/06/2026.

In the mean while, the applicant shall approach the competent Sessions Court in Kolhapur District for grant of anticipatory bail in connection with the aforesaid offence. 9.
