By this petition the applicant is seeking anticipatory bail in Crime No.83/2026, registered with Police Station Shegaon, District Chandrapur, for the offence punishable under Sections 3(5), 316(2) and 318(4) of the Bharatiya Nyaya Sanhita, 2023 and Section 3 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999. 2.

In brief, the case of the prosecution is that, on the information of the complainant that accused Roshanlal along with other accused have cheated the informant along with other eight people promising that they will distribute tractors to the tribal people and also assured that they should pay amount of Rs.2,50,000/- by cheque and Rs.50,000/- in cash and on that deposit the tractors would be made available to them. As such, they have obtained amount of Rs.24,75,000/- collectively but did not deliver the tractors. As a result, the offence is registered against the present applicant in the matter. 23-aba445.26.odt 2/3 this Court stating that firstly his name is not disclosed in the F.I.R. and secondly it is his submission that on the identical charges earlier on the complaint of Sachin Rathod the complaint was lodged at the Police Station Tumsar vide Crime No.470/2024. The identical allegations were made against the present applicant.

It is the submission of the applicant in the said proceeding he has been granted the anticipatory bail by Sessions Court, Bhandara on 12.11.2024 thereafter the charge-sheet was filed after conducting the full-fledge inquiry. The said proceeding are now pending before the trial Court. 4.

It is further submitted that considering the allegations which are levelled against the present applicant, in view of the fact that in identical matter he is released on bail and charge-sheet is filed after investigation, nothing is required to be recovered from the present applicant hence he seeks protection in the matter.

Learned A.P.P. has strongly opposed the application. According to him, the complainant has made specific allegations. Learned A.P.P. states that during the investigation the custody of the applicant would be required for reaching to the proper conclusion in the matter as the complainant is the different person.

In view of the fact that in identical matter the applicant is already granted anticipatory bail and charge-sheet is also filed in that matter I am of the opinion that applicant is entitled for the protection in the present matter. Accordingly following order is passed.

O R D E R

(i) The application is allowed.

(ii) In the event of arrest of the applicantSanjay s/o. Nandram Kangale, in Crime No.83/2026, registered with Police Sttion Shegaon, District Chandrapur, for the offence punishable under Sections 3(5), 316(2) and 318(4) of the Bharatiya Nyaya Sanhita, 2023 and Section 3 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999, the applicant be released on anticipatory bail on furnishing P.R. Bond of Rs.50,000/ (Rs. Fifty Thousand).

(iii) The applicant shall attend the Police Station as and when he was called by the Investigation Officer. (iv) The Investigation Officer shall issue preintimation of two days before calling the applicant at the Police Station.

(v) The application stands disposed of.
