Heard Mr. Nabar, learned Counsel appearing for the Applicant and Mr. Mangaonkar, learned APP for the RespondentState. 2.

By this Anticipatory Bail Application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the Applicant is seeking pre-arrest bail in connection with CR No.567 of 2024 registered with the Wanwadi Police Station, Pune City for the offences punishable under Sections 118(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

It is the submission of Mr. Nabar, learned Counsel for the Applicant that a scuffle took place between two groups and there are cross FIRs. He submits that the Applicant is not involved in the crime. He further submits that by Order dated 18th June 2025 a learned Single Judge has already protected the Applicant in Anticipatory Bail Application No.1518 of 2025. The said application was withdrawn as antecedent was not disclosed and thereafter, the present Anticipatory Bail Application is filed. Mr. Nabar, learned Counsel submits that the antecedent is of the year 2017.

On the other hand, Mr. Mangaonkar, learned APP strongly opposes the Anticipatory Bail Application. He submits that injury is grevious and therefore the Anticipatory Bail Application be dismissed. He submits that there is one antecedent. 5.

Perusal of the record shows that there are two crosscomplaints. A learned Single Judge has already granted interim protection by the Order dated 18th June 2025 in Anticipatory Bail Application No. 1518 of 2025. Perusal of the record shows that the investigation is almost completed. Although, there is one

antecedent the same is of the year 2017 and the Applicant has been granted bail.

Mr. Nabar, learned Counsel for the Applicant submits that the Applicant has completely cooperated with the investigation and herein after also the Applicant will cooperate with the investigation.

Accordingly, the case is made out for grant of Anticipatory Bail by imposing certain condition. In view of the above following order is passed :-

O R D E R

(a) In the event of arrest of the Applicant - Ganesh Raju Naidu in connection with C.R. No.567 of 2024 registered with the Wanwadi Police Station, Pune City, the Applicant is directed to be released on bail on his furnishing P.R. Bond in the sum of Rs. 25,000/- with one or two solvent sureties in the like amount. (b) The Applicant shall attend the concerned Police Station as and when called.

(c) The Applicant shall furnish his cell phone number and

residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.
