This is an application for Anticipatory Bail. 2.
The applicant is apprehending his arrest in Crime No. 1110 of 2025 registered at Samtanagar Police Station, for the offences punishable under Sections 352, 351(1), 191(2), 190, 189(4), 189(3), 189(2), 118(2) & 115(2) of the Bharatiya Nyaya Sanhita, 2023.

It is the case of the prosecution that on the date of the 1/4
incident, which took place on 16.12.2025, on account of trivial issue, a dispute arose between the first informant and the coaccused, Anmol Singh. It is alleged that during the said dispute, the present applicant and other co-accused assaulted the first informant by cement block and an iron rod.

I have heard the learned counsel for the applicant and the learned APP for the respondent-State.

The learned counsel for the applicant submits that the applicant has nothing to do with the alleged crime. It is submitted that nothing is to be recovered at the instance of the applicant and therefore there is no need of custodial interrogation. It is further submitted that there are no other criminal antecedents against the applicant.

On the other hand, the learned APP for the respondentState submits that the present applicant has assaulted the first informant by fist and kick blows. It is submitted that the first informant sustained grievous injury. It is submitted that considering the nature of crime, the applicant may not be released 2/4
on anticipatory bail.

I have perused the first information report. Prima-facie, the incident does not appear to be premeditated. The initial dispute was between the first informant and co-accused Anmol Singh. There are no other criminal antecedents against the present applicant. Considering the said facts, I am inclined to release the applicant on anticipatory bail. In the result, the following order is passed :
O R D E R
a) The Application is allowed.
b) In the event of arrest of the applicant in connection with Crime No. 1110 of 2025 registered at Samtanagar Police Station, for the offences punishable under Sections 352, 351(1), 191(2), 190, 189(4), 189(3), 189(2), 118(2) & 115(2) of the Bharatiya Nyaya Sanhita, 2023, the applicant be released on bail on furnishing P.R. Bond in the sum of Rs. 25,000/- with one or two sureties in the like 3/4
amount.
c) The applicant shall attend the concerned police station as and when called by the investigating officer and shall co-operate in the investigation.
