By this application, the applicant is seeking the anticipatory bail in Crime No.286/2026 registered with Police Station Shegaon City, Taluka-Shegaon, District-Buldhana for the offence punishable under Section 61(2), 316(2) and 318(4) of the Bharatiya Nyaya Sanhita, 2023.

It is pointed out by the applicant that the present applicant is the Vice-President of the Samarth Nagari Sahakari Pat Sanstha Limited, Shegaon. According to the applicant, on 9.6.2024, one agreement was executed with the Manager of the Pat Sanstha, wherein it has been stated that she has no concerned with the said Pat Sanstha and she has not signed on in any of the proceedings of the Pat Sanstha. According to the applicant, the alleged offence is registered on 5.5.2026, whereas this agreement is dated 9.6.2024 and hence it is a relevant document which needs consideration in the matter.

The learned APP has pointed out that the agreement dated 9.6.2024 cannot be considered at this stage and the custody
2 24 ABA 466.26.odt of the present applicant is required for disclosure and seizure of relevant document in respect of the alleged transactions. It is further stated that to know the modus operandi of the accused persons and to know the money trail, the custody of the applicant is necessary in the matter.

In my opinion, considering this agreement dated 9.6.2024 executed by Manager of Pat-Sanstha, wherein it is specifically recorded that the applicant has no concerned with the Pat Sanstha and she has not signed on any of the proceeding, prima facie, her involvement in the alleged offence is not seen in the matter. At the most, the applicant can be directed to cooperate the investigation till the filing of the chargesheet. In the circumstances, the applicant is entitled for anticipatory bail and accordingly following order is passed :
O R D E R
(i) The application is allowed.
(ii) In the event of arrest in connection with Crime No.286/2026 registered with Police Station Shegaon City, Taluka-Shegaon, District-Buldhana for the offence punishable under Section 61(2), 316(2) and 318(4) of the Bharatiya Nyaya Sanhita, 2023, the applicant-Manda w/o Rambhau Pohekar be released on bail on her executing P.R. Bond in the sum of Rs.50,000/- with one solvent surety in the like amount. (iii) The applicant shall attend the concerned Police Station on every Monday between 4.00 PM to 5.00 PM till the filing of the chargesheet and shall cooperate in the investigation. (iv) The applicant shall, at the time of execution of bond, furnish her address and telephone/mobile number (s), to
3 24 ABA 466.26.odt the investigating officer and the court concerned, and shall not change the same till the final disposal of the case. (v) The applicant shall not directly or indirectly make any inducement, threat or promise to any witness acquainted with the facts of the case so as to dissuade her from disclosing such facts to the court or any Police Officer. (vi) The applicant shall not obstruct or hamper the police investigation and not play mischief with the evidence collected or yet to be collected by the investigating officer. 6.
