By this application, the applicant is seeking adinterim bail in Crime No.261/2026 registered on 15.05.2026 for the offences punishable under Sections 34, 409, 420, 467, 468and 471 of the Indian Penal Code at Police Station Kelwad, District Nagpur.

In brief, the case of prosecution is that the present applicant in collusion with Gram Rojgar Sewak namely Pawan Yashwant Datarkar and other accused have shown works of repairing and new construction for the single irrigation well of Survey No.290/3 under the scheme of
irrigation well construction maintenance and new construction under the Mahatma Gandhi National Rural Employment Guarantee Scheme. It is alleged that the applicant along with other misguided the Government and misappropriated the Government funds to the tune of Rs.3,77,911/- and during the spot inspection, it is found that the work of well is not done as per the guidelines of the Government and work of only one well is there against two wells and there are discrepancies in the entries of measurements of irrigation well in the measurement book maintained by the Technical Assistant i.e. applicant and, therefore, the offence is registered against him in the matter.

The applicant has categorically stated in his application that he was called by the investigating officer to the police station and accordingly he has attended the police station on 17.05.2026 and co-operated with the investigation officer. He also stated that his statement has also been recorded by the investigating officer. As such, it is the submission of the applicant that he is cooperating in the investigation and will continue his cooperation in the alleged offence.

In view of this, in my opinion, the applicant has made out the case for ad-interim anticipatory bail and, therefore, I proceed to pass the following order:
ORDER
i) In the event of arrest in Crime No.261/2026 for the
offences punishable under Sections 34, 409, 420, 467, 468and 471 of the Indian Penal Code at Police Station Kelwad, District Nagpur, the Applicant - Prashant s/o Shamrao Wankhede be released on bail on his executing PR Bond in the sum of Rs.25,000/- with one solvent surety in the like amount.
ii) The Applicant shall attend the Police Station, Kelwad, District Nagpur, on every Monday and Friday from 11.00 a.m. to 01.00 p.m. till the filing of the charge-sheet and shall co-operate in the investigation.
iii) The Applicant shall also attend the Police Station, Kelwad, District Nagpur, if otherwise required on other days by the investigation officer with prior intimation from the investigation officer.
iv) The Applicant shall, at the time of execution of bond, furnish his address and telephone/mobile number(s) to the Investigating Officer and the Court concerned, and shall not change the same till the final disposal of the case.
v) The Applicant shall not directly or indirectly make any inducement, threat or promise to any witness acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or any Police Officer. vi) The Applicant shall not obstruct or hamper the police investigation and not play mischief with the evidence collected or yet to be collected by the Investigating officer.
vii) In case of breach of any conditions, the learned trial court is at liberty to cancel the bail after giving opportunity of hearing to both the sides.
