This application is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking pre-arrest bail in connection with C.R. No.305 of 2025 registered with Mhasrul Police Station, Nashik City, Nashik, for the offences punishable under Sections 309(4) and 3(5) of the Bharatiya Nyay Sanhita, 2023.

As per the prosecution case, the Applicant has purchased the stolen gold ornament.

It is the submission of Mr. Dhorde, learned Counsel appearing for the Applicant that the Applicant is not involved in the crime. To substantiate the contention, he relied on the report dated 19th December 2025 filed by the Investigating Officer, where it is stated that during investigation it was found that stolen article was purchased by Gunvant Chandrakant Dabhade of Satguru Jewelers and address is mentioned as at post- Kolpewadi, TalukaKopargaon, District-Ahilyanagar. Learned Counsel submits that the Applicant is from Shahajapur, post-Kolpewadi, Taluka- Kopargaon District-Ahilyanagar. He submits that the Applicant is not involved in the crime and in any case, the Applicant will co-operate with the investigation.

Ms. Newton, learned APP submits that during investigation, the role of the Applicant is disclosed. She therefore, submits that the Anticipatory Bail Application be rejected.

Perusal of the record shows that the Applicant has one antecedent of similar nature. The Applicant's name is not mentioned in the FIR. The role attributed to the Applicant is that he has purchased the stolen gold ornament. As the Applicant has undertaken to co-operate with the investigation, case is made out for grant of Anticipatory Bail. In view thereof, the following order is passed:
O R D E R
(a) In the event of arrest of the Applicant- Gunvant Chandrakant Dhabhade in connection with C.R. No.305 of 2025 registered with the Mhasrul Police Station, Nashik City, Nashik, the Applicant is directed to be released on bail on his furnishing P.R. Bond in the sum of Rs.1,00,000/- with one or two solvent sureties in the like amount.
(b) The Applicant shall attend the Mhasrul Police Station, Nashik City, Nashik, on 9th March 2026 and 10th March 2026 and shall co-operate with the investigation and thereafter, the Applicant shall attend the Mhasrul Police Station, Nashik City, Nashik, as and when called
by the Investigating Officer.
(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.
(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.
(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.
(f) The Applicant shall not leave India without prior permission of the learned Trial Court/concerned Sessions Court.
