This is an application for Anticipatory Bail. 2.
The applicant is apprehending his arrest in Crime No. 364 of 2025 registered at Rajgad Police Station, for the offences punishable under Sections 115(2), 118(1), 119(1), 351(2)(3), 352, 324(4) & 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3.
The applicant and the first informant are relatives. It is the case of the prosecution that on account of some immovable property, on the date of the incident, which took place on 1/3
01.10.2025 at about 10.00 pm, a dispute arose between the first informant and the applicant and during the said dispute the present applicant assaulted the first informant with a stick on his head.

I have heard the learned counsel for the applicant and the learned APP for the respondent-State.

The learned counsel for the applicant submits that there is a delay in lodging the FIR. It is submitted that false allegations are made against the present applicant because of the property dispute. It is further submitted that the applicant is ready and willing to co-operate in the investigation. 6.
On the other hand, the learned APP for the respondentState submits that the applicant is involved in four more crimes. It is submitted that considering the nature of crime, the applicant may not be released on anticipatory bail.

I have perused the First Information Report. There is a delay of six days in lodging the First Information Report. It appears 2/3
that there is a property dispute between the parties. Considering the said facts, I am inclined to release the applicant on anticipatory bail on certain conditions. In the result, the following order is passed :
O R D E R
a) The Application is allowed.
b) In the event of arrest of the applicant in connection with Crime No. 364 of 2025 registered at Rajgad Police Station, for the offences punishable under Sections 115(2), 118(1), 119(1), 351(2)(3), 352, 324(4) & 3(5) of the Bharatiya Nyaya Sanhita, 2023, the applicant be released on bail on furnishing P.R. Bond in the sum of Rs. 25,000/- with one or two sureties in the like amount.
c) Till the conclusion of the trial, the applicant shall not enter into the limits of Bhor Taluka. d) The applicant shall not commit any other crime.
