This is an Application for anticipatory bail. 2.
The Applicants are apprehending their arrest in Crime No.50 of 2026 registered with Trombay Police Station for the offences punishable under Sections 135, 37(1)(a) of the Maharashtra Police Act and Sections 109, 115(2), 189(2), 190, 191(2), 351(2), 352 of the Bharatiya Nyaya Sanhita, 2023.

It is the case of the prosecution that on the date of incident, which took place on 07th February 2026, due to previous dispute the present applicants and other co-accused assaulted the first informant and his friends by knife and attempted to commit their murders Accordingly, the present crime came to be registered.

I have heard Learned Counsel for the Applicants and Learned APP for the Respondent-State.

Learned Counsel for the Applicants submits that the Applicants have nothing to do with the alleged crime. It is submitted that the act of assault by knife is attributed to the co-accused. It is submitted that nothing is to be recovered at the instance of the present Applicants and therefore there is no need of custodial interrogation. It is submitted that there are no other criminal antecedents against the present Applicants. 6.
On the other hand, Learned APP for the Respondent-State submits that the Applicants are involved in a serious crime of attempt to murder. It is submitted that the Applicants were part of unlawful assembly and assaulted the first informant and his friend by fist and kick blows. It is submitted that considering the nature of crime, the Applicants may not be released on anticipatory bail.

I have perused the FIR. The alleged assault by knife is attributed to the co-accused. There appears to be no need of custodial interrogation. There are no other criminal antecedents against the present Applicants. Considering the overall facts and circumstances, I am inclined to release the Applicants on anticipatory bail. Hence, the following order:-
ORDER
i.
The Anticipatory Bail Application is allowed. ii.
In the event of the arrest of the Applicants in Crime No.50 of 2026 registered with Trombay Police Station for the offences
3 20-ABA 562-26.doc punishable under Sections 135, 37(1)(a) of the Maharashtra Police Act and Sections 109, 115(2), 189(2), 190, 191(2), 351(2), 352 of the Bharatiya Nyaya Sanhita, 2023, they shall be released on bail on furnishing a PR Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) each with one or two sureties in the like amount.
iii. The Applicants shall attend the concerned Police Station as and when called by the investigating officer and shall cooperate in the investigation. 8.
The Anticipatory Bail Application is disposed of in the aforesaid terms.
