By the present Anticipatory Bail Application, the

Applicant seeks pre-arrest bail, apprehending arrest in FIR bearing No. 38 of 2026, dated 6th February, 2026, registered with the Kalachawki Police Station, Mumbai (FIR), for offences punishable under Sections 316(4), 318(4), and Section 61 of the Bharatiya Nyaya Sanhita, 2023. Consequently, Sections 336(2), 336(3), and 39 of the BNS, 2023 were added to the said FIR. 3.

There are 16 Accused in the present crime. The Applicant is Accused No. 13.

Mr. Sanket Thorat, learned Advocate for the Applicant, by referring to the FIR, submits that the allegations therein are centered on Accused No. 1 (Shweta Rupesh Salvi), who was the Senior Accountant in the Company (i.e., Respondent No. 2). He submits that the Applicant is the husband of Accused No. 1. He refers to the FIR to submit that the allegations against the Applicant are that he threatened the Directors of the Company. He refers to Paragraph No. 13 of the FIR, which states that although the Applicant is listed as a beneficiary (Labharthi), the FIR does not reflect any amount towards the Applicant's name. He states

that the Applicant has two minor children, who are twins (6 years of age). He submits that, apart from the Applicant, there is no one else to look after them. He submits that the Applicant has cooperated with the investigation and shall continue to co-operate. 5.

Mr. A. A. Palkar, learned APP for the State, submits that although the allegations in the FIR pertain to the Applicant threatening the Directors of the Company, during the course of the investigation, an amount of Rs. 2,50,000/- has been traced in the Applicant's account, which is the subject matter of the present crime. However, on the instructions of the Investigating Officer Kalachawki Police Station, Mr. A. A. Palkar states that the custodial interrogation of the Applicant is not required. 6.

Mr. Sanjog Parab, learned Senior Advocate for Respondent No. 2, submits that if the prosecution does not require the custodial interrogation of the Applicant, he does not object to this Application. However, he reiterates that Accused No. 1, who is the wife of the Applicant, is the mastermind behind the present crime and is responsible for siphoning Rs.6,49,03,577/- from the

Company.

Considering the role assigned to the Applicant in the present crime, which is of threatening the Directors and the statement made by Mr. A. A. Palkar, learned APP, on instructions from the Investigating Officer, Kalachawki Police Station that the custodial interrogation of the Applicant is not required, this Application is allowed on the following terms :- (a) In the event of arrest of the Applicant in FIR No.38 of 2026 dated 6th February 2026 registered with Kalachawki Police Station, Mumbai, the Applicant shall be released on bail on furnishing a PR bond in the sum of Rs. 50,000/- (Fifty Thousand only) with one or two local sureties in the like amount.

(b) The Applicant shall report to the Investigating Officer at Kalachawki Police Station, Mumbai, every Monday of each month, commencing from 11th May, 2026, between 11.00 am and 12.00 pm. In the event

the Applicant is required to report on any other day by the Investigating Officer Kalachawki Police Station, the Applicant shall ensure his presence before the Investigating Officer.

(c) Applicant shall not directly or indirectly make any inducement, threat or promise to any person/s acquainted with the facts of the case to dissuade such person/s from disclosing the facts to the Court or any police officer.

(d) Applicant shall not tamper with evidence in any manner.

(e) Applicant shall provide the Investigating Officer with his residential address along with proof, his contact number, email and must inform the Investigating Officer of any changes to this information from time to time.

(f) Applicant shall co-operate with the Investigating Officer in the process of investigation of the present Crime.
