This is an application for Anticipatory Bail. 2.

The applicants are apprehending their arrest in Crime No. 13 of 2026 registered at Boisar Police Station, for the offences punishable under Sections 318(4), 336(3), 338 & 3(5) of the Bharatiya Nyaya Sanhita, 2023.

It is the case of the prosecution that the present applicants and other co-accused, on the basis of forged documents in respect of certain construction contract, defrauded the first informant to the tune of Rs.1,03,12,564/-. 1/3

I have heard the learned counsel for the applicants and the learned APP for the respondent-State.

The learned counsel for the applicants submits that the applicants have nothing to do with the alleged crime. It is submitted that main allegations are against co-accused Awadesh Singh. It is submitted that the applicants came to be implicated in the crime in question, as the applicant No.1 is the father and applicant No.2 is the brother of said co-accused Awadesh Singh. It is submitted that nothing is to be recovered at the instance of the applicants and therefore there is no need of custodial interrogation. It is further submitted that there are no other criminal antecedents against the present applicants. 6.

On the other hand, the learned APP for the respondentState submits that considering the nature of crime, the applicants may not be released on anticipatory bail.

I have perused the First Information Report. The main allegations are against co-accused Awadesh Singh. There appears to be no need of custodial interrogation. There are no other 2/3

criminal antecedents against the applicants. Considering the overall facts and circumstances, I am inclined to release the applicants on anticipatory bail. In the result, the following order is passed :

O R D E R

a) The Application is allowed.

b) In the event of arrest of the applicants in connection with Crime No. 13 of 2026 registered at Boisar Police Station, for the offences punishable under Sections 318(4), 336(3), 338 & 3(5) of the Bharatiya Nyaya Sanhita, 2023, the applicants be released on bail on furnishing P.R. Bond in the sum of Rs. 25,000/- each with one or two sureties in the like amount.

c) The applicants shall attend the concerned police station as and when called by the investigating officer and shall co-operate in the investigation.
