This is an Application for anticipatory bail. 2.

The Applicants are apprehending their arrest in Crime No.57 of 2026 registered with Uran Police Station for the offences punishable under Sections 118(2), 324(4), 351(2), 352 read with 3(5) of the Bharatiya Nyaya Sanhita, 2023.

It is the case of the prosecution that on the date of incident, which took place on 28th February 2026, the present Applicants along with other co-accused on some trivial issue assaulted the first informant by stumps, due to which he sustained grievous injuries.

I have heard Learned Counsel for the Applicant and Learned APP for the Respondent-State.

Learned Counsel for the Applicants submits that false allegations are made against the Applicants just to give it a colour of serious offence. It is submitted that the incident was not premeditated. It is submitted that there are no other criminal antecedents against the Applicants. 6.

On the other hand, Learned APP for the Respondent-State submits that Applicant No.1 has assaulted the first informant by stump. It is submitted that considering the nature of crime, the Applicants may not be released on anticipatory bail.

I have perused the FIR. Prima facie the incident does not appear to be premeditated. There are no other criminal antecedents against the present Applicants. Considering the overall facts and circumstances, I am inclined to release the Applicants on anticipatory bail. Hence, the following order:-

ORDER

i.

The Anticipatory Bail Application is allowed. ii.

In the event of the arrest of the Applicants in Crime No.57 of 2026 registered with Uran Police Station for the offences punishable under Sections 118(2), 324(4), 351(2), 352 read with 3(5) of the Bharatiya Nyaya Sanhita, 2023, they shall be released on bail on furnishing a PR Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) each with one or two sureties in the like amount.

iii. Applicant No.1, viz., Atul Anant Madhavi shall attend the concerned Police Station daily between 11.00 a.m. to 2.00 p.m. till filing of the chargesheet and shall co-operate in the

3 920-ABA 656-26.doc investigation. After filing of the chargesheet, the Applicant No.1 shall attend the concerned Police Station once in a month, i.e., on every first Saturday between 11.00 a.m. to 1.00 p.m. till conclusion of the trial.

iv.

Applicant No.2, viz., Yatin Amrut Madhavi shall attend the concerned Police Station as and when called by the investigating officer and shall co-operate in the investigation. 8.

The Anticipatory Bail Application is disposed of in the aforesaid terms.
