This is an application for anticipatory bail. 3.

The applicant is apprehending his arrest in Crime No. 57 of 2026 registered at Warje Malewadi Police Station, Pune for the offences punishable under Sections 85, 74, 75, 88, 115(2), 351(2), and 352 of the Bharatiya Nyaya Sanhita, 2023. 4.

The applicant is a brother in law of the first informant. The allegations against the present applicant and other co-accused are of cruelty. In addition to it, there are allegations against the applicant of outraging the modesty of first informant. 1/3

I have heard the learned senior counsel appearing for the applicant, the learned APP for the respondent / State and learned counsel for the respondent No.2 6.

Learned senior counsel for the applicant submits that due to matrimonial dispute, false allegations are made against the present applicant. It is submitted that nothing is to be recovered at the instance of the applicant and therefore, there is no need of custodial interrogation. It is submitted that the applicant is ready to cooperate in the investigation.

On the other hand, learned APP for the respondent/State and the learned counsel for the respondent No.2/first informant submit that there are specific allegations against the applicant of outraging the modesty of the first informant. It is submitted that considering the nature of crime, the applicant may not be released on anticipatory bail.

I have perused the First Information Report. The allegations in respect of outraging the modesty are bereft of any particulars. There appears to be no need of custodial interrogation of the applicant. In that view of the matter, I am inclined to release the applicant on anticipatory bail. In the result, the following order is passed.

ORDER

A) The Application is allowed.

B) In the event of arrest of the applicant in C.R. No.57 of 2026 registered at Warje Malewadi Police Station, Pune for the offences punishable under Sections 85, 74, 75, 88, 115(2), 351(2), and 352 of the Bharatiya Nyaya Sanhita, 2023, he be released on bail on executing P.R. Bond in the sum of Rs.25,000/- with one surety or two sureties in the like amount.

C) The applicant shall attend the concerned police station as and when called by the Investigating Officer and shall cooperate in the investigation.

D) The applicant shall not tamper with the prosecution evidence and shall not threaten the witnesses. [N.R.BORKAR, J.] 3/3
