This is an application for Anticipatory Bail. 2.

The applicant is apprehending her arrest in Crime No. 653 of 2024 registered at Sahar Police Station, for the offences punishable under Sections 406 and 420 of the Indian Penal Code. 3.

It is the case of the prosecution that the applicant induced the first informant to invest money in his proposed company, which he promised to open in the name of first informant's son and daughter. It is alleged that on that pretext, 1/3

the applicant defrauded the first informant to the tune of Rs.93,00,000/-.

I have heard the learned counsel for the applicant, the learned APP for the respondent-State and the learned counsel for the first informant.

The learned counsel for the applicant has drawn my attention to the documents annexed to the application at page Nos. 82 and 85. By the said documents, the first informant and his son have acknowledged to have received an amount of Rs.77,00,000/- and Rs. 97,00,000/- respectively from the present applicant and agreed to repay the said amount to the present applicant.

The said documents are not shown to be forged. The dispute between the parties therefore appears to be purely of a civil nature. In that view of the matter, I am inclined to release the applicant on anticipatory bail. In the result, the following order is passed :

a) The Application is allowed.

b) In the event of arrest of the applicant in connection with Crime No. 653 of 2024 registered at Sahar Police Station, for the offences punishable under Sections 406 and 420 of the Indian Penal Code, the applicant be released on bail on furnishing P.R. Bond in the sum of Rs. 25,000/- with one or two sureties in the like amount.

c) The applicant shall attend the concerned police station as and when called by the investigating officer and shall co-operate in the investigation.
