This is an Application for anticipatory bail. 2.

The Applicant is apprehending his arrest in Crime No.493 of 2025 registered with Baramati Police Station Police Station for the offences punishable under Sections 109, 189(2), 191(2), 191(3), 190 of the Bharatiya Nyaya Sanhita, 2023.

It is the case of the prosecution that on the date of incident, which took place on 29th November 2025, dispute arose between the Applicant and First Informant on the parking issue. It is alleged that on account of said dispute, the present Applicant along with other co-accused assaulted the first informant and other injured in the present crime by iron rods and stones and attempted to commit their murder.

I have heard Learned Counsel for the Applicant and Learned APP for the Respondent-State.

Learned Counsel for the Applicant submits that the incident was not premeditated. It is submitted that the investigation is over and the prosecution has filed chargesheet against the other co-accused. It is submitted that nothing is to be recovered from the Applicant and therefore there is no need of custodial interrogation.

On the other hand, Learned APP for the Respondent-State submits that the Applicant is involved in serious crime of attempt to murder. It is submitted that considering the nature of crime, the Applicant may not be released on anticipatory bail.

I have perused the injury certificates. The injuries are simple in nature. Prima-facie the incident does not appear to be premeditated. In that view of the matter, I am inclined to release the Applicant on anticipatory bail on certain conditions. Hence, the following order:-

ORDER

i.

The Anticipatory Bail Application is allowed. ii.

In the event of the arrest of the Applicant in Crime No.493 of 2025 registered with Baramati Police Station Police Station for the offences punishable under Sections 109, 189(2), 191(2), 191(3), 190 of the Bharatiya Nyaya Sanhita, 2023, he shall be released on bail on furnishing a PR Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with one or two sureties in the like amount.

3 913-ABA 748-26.doc iii. The Applicant shall not commit any other crime. iv.

Till conclusion of the trial, the Applicant shall attend the concerned Police Station once in a month, i.e., on First Saturday between 11.00 a.m. to 2.00 p.m.

The Anticipatory Bail Application is disposed of in the aforesaid terms.
