This is an application for anticipatory bail. 3.
The applicants are apprehending their arrest in Crime No.104 of 2026 registered at Vashi Police Station, Navi Mumbai for the offences punishable under Sections 115(2), 118(1), 324(2), 351(2), 352 and 3(5) of the Bharatiya Nyaya Sanhita, 2023. 4.
According to the prosecution, on the date of incident which took place on 21st February 2026, dispute arose between the first informant and the applicant No.2 on account of construction of road and during the said dispute, it is alleged that the present applicants and other co-accused assaulted the first informant by iron rod and stone.

I have heard the learned counsel appearing for the applicant and the learned APP for the respondent / State. 6.
Learned counsel for the applicants submits that with ulterior motive false allegations are made against the present applicants. It is submitted that there are no other criminal antecedents against the applicants. It is further submitted that the applicants are ready and willing to cooperate in the investigation. 7.
On the other hand, learned APP for the respondent/State submits that the applicants have assaulted the first informant by stone and iron rod. It is submitted that considering the nature of crime, the applicants may not be released on anticipatory bail. 8.
I have perused the FIR. Prima facie, the incident does not appear to be premeditated. The nature of injuries appear to be simple. There are no other criminal antecedents against the applicants. Considering these facts, I am inclined to release the applicants on anticipatory bail. In the result, the following order is passed.
ORDER
A) The Application is allowed.
B) In the event of arrest of the applicants in C.R. No.104 of 2026 registered at Vashi Police Station, Navi Mumbai for the offences punishable under Sections 115(2), 118(1), 324(2), 351(2), 352 and 3(5) of the Bharatiya Nyaya Sanhita, 2/3
2023, they be released on bail on executing P.R. Bond in the sum of Rs.25,000/- each with one surety or two sureties in the like amount.
C) The applicants shall attend the concerned police station as and when called by the Investigating Officer and shall cooperate in the investigation.
