This is an application for anticipatory bail. 2.

The applicants are apprehending their arrest in Crime No.315 of 2025 registered at Bolinj Police Station, Mira-Bhayander, Vasai Virar for the offences punishable under Sections 118(1), 351(2), 352, 324(2) and 3(5) of the Bharatiya Nyaya Sanhita 2023. 3.

It is the case of the prosecution that on the date of incident which took place on 4th October 2025, on account of business rivalry the present applicants assaulted the first informant by stick, due to which he sustained grievous injuries. 4.

I have heard the learned counsel appearing for the applicant and the learned APP for the respondent / State. 1/3

Learned counsel for the applicant submits that the applicant No.1 was also injured in the alleged incident and there is a cross FIR to that effect. It is submitted that the applicants are ready to cooperate in the investigation. It is further submitted that there are no other criminal antecedents against the applicants. 6.

On the other hand, learned APP for the respondent/State submits that there are eye-witnesses to the incident. It is submitted that to recover the stick, the custodial interrogation of the applicants is necessary. It is submitted that considering the nature of crime, the applicants may not be released on anticipatory bail.

The fact that there is a cross FIR in relation to the alleged incident is not disputed. There are no other criminal antecedents against the applicants. Considering these facts, I am inclined to release the applicants on anticipatory bail on certain conditions. In the result, the following order is passed.

ORDER

A) The Application is allowed.

B) In the event of arrest of the applicants in C.R. No.315 of 2025 registered at Bolinj Police Station, Mira-Bhayander, Vasai Virar for the offences punishable under Sections 118(1), 351(2), 352, 324(2) and 3(5) of the Bharatiya Nyaya Sanhita 2023, they be released on bail on executing P.R. Bond in the sum of Rs.25,000/- each with one surety or two sureties in the like amount.

C) The applicants shall attend the concerned police station as and when called by the Investigating Officer and shall cooperate in the investigation.

D) After filing of the charge-sheet, the applicants shall attend the concerned police station once in a month, i.e., on first Saturday between 11.00 am to 2.00 p.m. till conclusion of trial.

E) The applicants shall not commit any other crime. [N.R.BORKAR, J.] 3/3
