This is an Application for anticipatory bail. 2.
The Applicant is apprehending his arrest in Crime No.115 of 2026 registered with Tilak Nagar Police Station for the offences punishable under Sections 115(2), 3(5), 308(5), 351(3), 352 of the Bharatiya Nyaya Sanhita, 2023.

It is the case of the prosecution that the Applicant and co-accused to allow the first informant to run the canteen at L.T.T. Railway Station demanded extortion money.

I have heard Learned Counsel for the Applicant and Learned APP for the Respondent-State.

Learned Counsel for the Applicant submits that with some ulterior
2 926-ABA 774-26.doc motive, false allegations are made against the present Applicant. It is submitted that no amount is paid to the Applicant. It is submitted that there is no need of custodial interrogation and the Applicant is ready and willing to cooperate in the investigation.

On the other hand, Learned APP for the Respondent-State submits that the Applicant is involved in serious crime of extortion. It is submitted that the Applicant is involved in one more crime of a similar nature which is registered after registration of the present crime. It is submitted that considering the nature of crime, the Applicant may not be released on anticipatory bail.

I have perused the FIR. The main allegations are against the coaccused Setubhai Pillai. The Learned Magistrate has released him on bail. Considering the overall facts and circumstances of the case, I am inclined to release the Applicant on anticipatory bail on certain conditions. Hence, the following order:-
ORDER
i.
The Anticipatory Bail Application is allowed. ii.
In the event of the arrest of the Applicant in Crime No.115 of 2026 registered with Tilak Nagar Police Station for the offences punishable under Sections 115(2), 3(5), 308(5), 351(3), 352 of the Bharatiya Nyaya Sanhita, 2023, he shall be released on bail on furnishing a PR Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with one or two sureties in the like amount.
iii. The Applicant shall not commit any other crime.

Till conclusion of the trial, the Applicant shall not enter into the jurisdiction of Tilak Nagar Police Station, unless he is called for the purpose of investigation.

The Anticipatory Bail Application is disposed of in the aforesaid terms.
