This is an Application for anticipatory bail. 2.
The Applicant is apprehending his arrest in Crime No.63 of 2026 registered with Dighi Police Station, Pimpari-Chinchwad for the offences punishable under Sections Sections 3, 4, 5 and 7 of the Immoral Traffic (Prevention) Act, 1956 and 143(3), 3(5) of the Bharatiya Nyaya Sanhita, 2023.

It is the case of the prosecution that on 10th February 2026, on the basis of the secrete information, a raid was conducted at Sai Palace Hotel and it was found that the present Applicant and other co-accused were running brothel in the said Hotel.

I have heard Learned Counsel for the Applicant and Learned APP for the Respondent-State.

Learned Counsel for the Applicant submits that the Applicant has nothing to do with the alleged crime. It is submitted that the hotel was given on leave and licence basis to one Padmalochan Das @ Kalusheth. It is submitted that there is no need of custodial interrogation and the Applicant is ready and willing to cooperate in the investigation. It is further submitted that the Applicant, without prejudice to his rights and contentions, is ready and willing to pay an amount of Rs.1,00,000/- to the Police Welfare Fund.

On the other hand, Learned APP for the Respondent-State submits that the Applicant is the owner of the said hotel. It is further submitted that the Applicant is involved in one more crime of a similar nature. It is submitted that considering the nature of crime, the Applicant may not be released on anticipatory bail.

I have perused the statements of victims. It appears from their statements that the co-accused Padmalochan Das @ Kalusheth was running the said brothel. In that view of the matter, I am inclined to release the Applicant on anticipatory bail. Hence, the following order:-
ORDER
i.
The Anticipatory Bail Application is allowed. ii.
In the event of the arrest of the Applicant in Crime No.63 of 2026 registered with Dighi Police Station, Pimpari-Chinchwad for the offences punishable under Sections Sections 3, 4, 5 and 7 of the Immoral Traffic (Prevention) Act, 1956 and 143(3), 3(5) of the Bharatiya Nyaya Sanhita, 2023, he shall be released on bail on furnishing a PR Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with one or

iii. The Applicant shall attend the concerned Police Station as and when called by the investigating officer and shall co-operate in the investigation.
iv.
The Applicant shall deposit an amount of Rs.1,00,000/- in the following bank account of the Police Welfare Fund within a period of six weeks from today.
