This Application was listed on 28 April 2026. Mr. Ratnish Dubey learned Advocate for the Applicant, submitted that the Applicant is neither named in the FIR nor in the charge-sheet. He further submitted that apprehension of arrest was solely on the basis of a phone call received from the Cyber Police Station. Learned APP had requested time till today to verify the said contention of Mr. Ratnish Dubey. 2.
Today, Mr. Sukanta Karmakar learned APP for the Respondent-State, submits that the Applicant is named in the charge-sheet and that he can point out the Applicant's role in
the offence. However, Mr. Sukanta Karmakar, learned APP for the Respondent-State, submits that the Applicant has not made any averments in respect of "criminal antecedents" if any. By relying on the decision of the Hon'ble Supreme Court in the case of Munnesh v. State of U.P.1, requests the dismissal of this Application on this count alone.

Faced with the said objection in the context of statements pertaining to "criminal antecedents", Mr Ratnish Dubey, learned Advocate for the Applicant, seeks leave to make appropriate amendments in the Application. He requests two weeks' time.

Mr. Sukanta Karmakar, learned APP for the RespondentState, though does not object to the request for amendment, reserves his rights to contest the said statement, as and when made.

At the request of Mr. Ratnish Dubey, learned Advocate for the Applicant, leave granted to carry out the amendment. The same be carried out within a period of two weeks as prayed. An amended copy of the Application be served on the office of the APP within one week thereafter. 6.
Mr. Ratnish Dubey learned Advocate for the Applicant, also seeks leave to produce the charge-sheet on record. Leave granted. The same is to be produced within two weeks from today, with a copy to the office of the APP.
