By the present Application filed under section 482 of BNSS 2023, the Applicant is before this Court seeking pre-arrest bail, apprehending arrest in Crime No. 0094 of 2026 registered with Sanpada Police Station, Navi Mumbai (hereinafter "impugned FIR"), for offences punishable under Section 316(4) of the Bharatiya Nyaya Sanhita, 2023, and Sections 43 and 66(C) of the Information Technology Act, 2000.

Ms. Pallavi Dabholkar learned APP for the Respondent - State, in all fairness, on instructions from the Investigation Officer
who is present in Court, states that the Applicant has been cooperating in the investigation. She further states that if the Applicant makes a statement before this Court that he shall appear before the Investigation Officer at Sanpada Police Station, Navi Mumbai, on the 2nd and 4th Saturdays of each month between 10:00 am to 12:00 pm and as and when required by the Investigation Officer, then the Respondent No. 1 would not require the Applicant for custodial interrogation.

Mr. Amol Patankar learned Advocate for the Applicant, on instructions from the Applicant states that the Applicant shall remain present and attend the Sanpada Police Station, Navi Mumbai, on the 2nd and 4th Saturdays of each month between 10:00 am and 12:00 pm, commencing from the month of May 2026 and further as and when required by the Investigation Officer. He states that the Applicant shall cooperate with the investigation in the impugned FIR. He further on instruction from the Applicant states that the said statement be treated as an undertaking of the Applicant to this Court. The statements made by Mr. Amol Patankar on instructions from the Applicant are
accepted.

In view of the statements made by Mr. Amol Patankar on instructions from the Applicant, Ms. Pallavi Dabholkar learned APP states, that Respondent has no objection to allowing this Application, subject to imposing conditions.

In view of the above, this Application is allowed on the following terms :- (a) In the event of arrest of the Applicant in FIR 0094 of 2026 dated 03/04/2026, registered with Sanpada Police Station, Navi Mumbai, the Applicant shall be released on bail on furnishing a PR bond in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand only) with one or two local sureties in the like amount.
(b) Applicant shall report to the Investigation Officer, Sanpada Police Station, Navi Mumbai, on the 2nd and 4th Saturday of every month between 10.00 am to 12.00 pm., commencing from the month of May 2026. In the event the Applicant is required on any other day, by the Investigating Officer, Sanpada Police Station Navi Mumbai, the
Applicant shall ensure his presence before the Investigating Officer.
(c) Applicant shall not directly or indirectly make any inducement, threat or promise to any person/s acquainted with the facts of the case to dissuade such person/s from disclosing the facts to the Court or any police officer.
(d) Applicant shall not tamper with evidence in any manner.
(e) Applicant shall provide the Investigation Officer with his residential address along with proof, his contact number, email and must inform the Investigating Officer of any changes to this information from time to time.
(f) Applicant shall cooperate with the Investigating Officer in the process of investigation of the present Crime.

Anticipatory Bail Application No. 1095 of 2026 is disposed of.
