The Applicants are apprehending arrest, in connection with investigation of Crime No.57 of 2026 registered with Wadivarhe Police Station, Nashik Rural, for the offences punishable under Sections 74, 333, 119(1), 324(4), 115, 351(2), 352 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 ('BNS' for short).

It is prosecution's case that on 30th March 2026, the Applicants outraged the modesty of the First Informant and assaulted her alongwith her mother-in-law with slaps, kicks and fist blows. 3.

It is contention of learned counsel for the Applicants that the Applicants are falsely implicated in this case. On 31st March 2026, wife of

the Applicant No.1 lodged complaint against the husband of the First Informant under the provisions of Protection of Children from Sexual Offences Act, 2012. ('POCSO' for short). To counter it present complaint is filed. Hence, requested to allow the Application. 4.

It is contention of learned APP that the Applicants have outraged the modesty of the First Informant and assaulted her alongwith her motherin-law. The allegations against the Applicants are serious in nature. Their custodial interrogation is required and requested to reject the Application. 5.

I have heard both learned counsel. Perused FIR and documents produced on record.

It appears from record that First Informant and Applicants have lodged complaint against each other.

Considering the nature of allegations and complaints filed against each other custodial interrogation of the Applicants is not required and I pass following order.

ORDER

(i) The Application is allowed.

(ii) In the event of their arrest in connection with investigation of Crime No.57 of 2026 registered with Wadivarhe Police Station, Nashik Rural, the applicants shall be

released on bail on executing a P.R. Bond in the sum of Rs.25,000/- each with one or two solvent sureties each in the like amount.

(iii) The applicants shall attend the concerned Police Station as and when required.

(iv) The applicants shall co-operate with the Investigating Agency and shall not tamper with the prosecution witnesses/evidence.

(v) The Application is disposed of in above terms. (vi) All pending Applications are disposed of.
