By the present Application filed under section 482 of BNSS 2023, the Applicant is before this Court seeking pre-arrest bail, apprehending arrest in Crime No. 555 of 2025, dated 31.07.2025 registered with the Shirur Police Station, Raigad District, Pune Rural (hereafter "impugned FIR") for the offences punishable under Section 316(2) of the Bharatiya Nyaya Sanhita, 2023. 2.

Mr. Vivek Arote, learned Advocate for the Applicant, submits that the subject matter of the impugned FIR is a misunderstanding between the Applicant and the Complainant. To clarify, he submits that the Applicant and the Complainant are friends. He further

submits that the Applicant had taken the Complainant's gold chain to make a similar chain for himself, which the Complainant misunderstood, resulting in the filing of the impugned FIR. He states that the Applicant shall hand over the gold chain to the Investigation Officer at Shirur Police Station, Raigad District. 3.

Mrs. Rajeshree Newton learned APP for the Respondent - State, on instructions from the Investigation Officer who is present in Court, submits that if the Applicant hands over the gold chain, which is the subject matter of the impugned FIR, to the Investigation Officer the custodial interrogation of the Applicant in this crime is not required and this Application can be allowed. 4.

Mr. Vivek Arote learned Advocate for the Applicant, on instructions from the Applicant states that the said gold chain shall be handed over to the Investigation Officer, Shirur Police Station, Raigad District, within a period of 3 days from today. Statement made by Mr. Vivek Arote learned Advocate for the Applicant is accepted.

In view of the above, this Application is allowed on the

following terms :- (a) In the event of arrest of the Applicant in the C. R. No. 555 of 2025 dated 31.07.2025, registered with Shirur Police Station, Pune Rural District, the Applicant shall be released on bail on furnishing a PR bond in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand only) with one or two local sureties in the like amount.

(b) Applicant shall report to the Investigation Officer, Shirur Police Station, Pune Rural District, on 2nd and 4th Saturdays of every month between 11.00 am to 12.00 pm., commencing from the month of May 2026. In the event the Applicant is required on any other day, by the Investigating Officer, Shirur Police Station, Pune Rural District, the Applicant shall ensure his presence before the Investigating Officer.

(c) Applicant shall abide and comply with the statement made by his Advocate Mr. Vivek Arote as recorded in para (4) of this order, failing which the Respondent is entitled to seek cancellation of this bail.

(d) Applicant shall not directly or indirectly make any inducement, threat or promise to any person/s acquainted with the facts of the case to dissuade such person/s from disclosing the facts to the Court or any police officer.

(e) Applicant shall not tamper with evidence in any manner.

(f) Applicant shall provide the Investigation Officer with his residential address along with proof, his contact number, email and must inform the Investigating Officer of any changes to this information from time to time.

(g) Applicant shall cooperate with the Investigating Officer in the process of investigation of the present Crime.

Anticipatory Bail Application No. 1099 of 2026 is disposed off.
