The applicant apprehends arrest in C.R.No. 478 of 2025 registered with Mumbai Naka Police Station, Nashik for the offence punishable under Sections 103(1), 115, 351(3), 61(2), 249, 3(5), 37(1), 37(3), 135 of Maharashtra Police Act, 1951 and Sections 4 and 25 of Arms Act, 1959.

It is prosecution's case that deceased had love affair with the wife of the applicant and on that ground, co-accused stabbed and murdered him using a knife. It is alleged that knife used in the crime was provided by the applicant.

It is contention of learned counsel for the applicant that name of the applicant is not mentioned in the FIR. The allegations of providing knife to the co-accused are false. There is no recovery at the instance of the applicant. Hence, custodial interrogation of the applicant is not

It is contention of learned APP that there is statement of witness which shows that knife used in crime was provided by the applicant and he conspired to kill the deceased. The allegations against the applicant are serious. Hence, his custodial interrogation is required and requested to reject the application.

I have heard both the learned counsel. Perused FIR and documents produced on record. It is alleged that the deceased had love affair with the wife of the applicant. It shows that applicant had motive to kill the deceased. It appears from the record that the applicant had provided knife to the co-accused, which was used in the crime. Allegations against the accused are of conspiracy. It shows his involvement in the crime. The allegations against the applicant are serious. The cousin brother of the first informant was brutally murdered by the co-accused as he had love affair with the applicant's wife. Investigation is in progress, custodial interrogation of the applicant is required and I pass following order.

ORDER

(i) The Anticipatory Bail Application is rejected. (SHIVKUMAR DIGE, J.)
