Heard learned counsel for the Applicants.

At the outset, learned counsel for the Applicants submits that Applicant No.1 came to be arrested during the pendency of the instant application and therefore, he does not press for relief as far as Applicant No.1 is concerned.

As far as Applicant No.2 is concerned, he submits that Applicant No.2 is falsely implicated in the offence under Sections 318 (4), 270, 324 (4), 3(5) of the Bharatiya Nyaya Sanhita, 2023 r/w Section 11(1) of the Prevention of Cruelty to Animals Act, 1960 and 1/3

there is no need for custody of this applicant. 4.

Learned APP, on instructions of the Investigating Officer, who is personally present in the Court submits that the fact about arrest of applicant No.1 is not disputed and as far as Applicant No.2 is concerned, he states that the Investigating Officer expects cooperation from him by attending the Police Station as and when directed.

Having regard to contents of the FIR and the submissions advanced, the Bail Application can be disposed of by directing the Applicant No.2 to co-operate with the Investigation Agency and attend the Police Station as and when called upon.

Hence, I pass following order.

: : O R D E R : :

i] The Application is disposed of as withdrawn, as regards Applicant No.1 is concerned.

ii] In the event of arrest of the Applicant No.2, he be released on bail, on furnishing P. R. Bond of Rs.25,000/- (Rupees Twenty-five Thousand Only) with solvent surety in the like amount.

iii] The Applicant No. 2 shall attend the concerned Police Station on every Tuesday between 10.00 a.m. 2/3

to 6.00 p.m., and as when called upon by the Investigating Officer till filing of the charge-sheet. iv] The Applicant No.2 shall co-operate the Investigating Agency during investigation and trial. 7.

In view of the above, the instant Anticipatory Bail Application is disposed of.
