Learned Counsel Shri N.J. Patil, waives for nonapplicant No.2. 5.

The applicant and non-applicant jointly stated that there is an element of compromise between the parties. Both the parties are willing to compromise the matter. However, the learned APP has stated that it will be necessary to verify whether for the offences under Sections 64 and 69 of the Bharatiya Nyaya Sanhita, 2023, are compoundable in the matter and they seek time in the matter.

In light of these facts and circumstances, the applicant has stated that he being serving as a Constable in Naxalite area Atagad,(Chhattisgarh), he is required to

2 910 apl 124-2026 join a post within two days and it will be impossible for him to attend the proceedings on the day, on which, the matter will be kept by this Court. Hence, he requested his exemption in the event if this Court permits the compromise between the parties.

In light of the submission made by applicant and learned APP, the matter is posted for two weeks. 8.

In case the compromise is permissible in the matter, on that day, the applicant is permitted to appear through video conferencing.

Hence, list this matter after two weeks.
