By this application, the applicants and nonapplicant No.2 seek quashment of the proceedings on the ground that there was a compromise deed executed between the parties on 08.12.2005.

The perusal of the record shows that the dispute is arising out of a matrimonial dispute and they have amicably settled between them. In view of the judgment of the Hon'ble Supreme Court of India in the case of B.S. Joshi and ors. Vs. State of Haryana and ors. reported in (2003) 4 SCC 675, wherein it is held that there is no impediment if the parties reached to arrive at a settlement in a matrimonial dispute.

Today, both the parties are present before this Court. The respective Counsel have identified them and

907 apl 174-2026.odt also verified their signatures on the compromised deed. So also, non-applicant No.2 has filed an affidavit on record stating that their settlement is arrived between them and she has no objection for setting aside the criminal proceedings registered against the present applicants. 4.

In the circumstances, offence registered against the present applicants vide Crime No.0214/2025 with Police Station, Ajani, Nagpur, for the offences punishable under Sections 85, 115(2), 351(2), 352 of the Bharatiya Nyaya Sanhita, 2023 and Sections 3 and 4 of the Dowry Prohibition Act, 1961, is hereby quashed and set aside. 5.

The application stands disposed of. No order as to the costs.
