The applicants herein challenged the proceedings registered against them vide Regular Criminal Case No.1484/2023 pending on the file of learned Judicial Magistrate First Class, Nagpur, for the offence punishable under Section 498-A read with Section 34 of the Indian Penal Code.

During the pendency of the investigation, the matter has been amicably settled between the parties and they have decided to obtain mutual divorce on certain terms and conditions. It is also pointed out in Marriage Petition No.286/2024, the said consent terms were also placed on record.

Today, the applicants and non-applicant No.2 are in the Court. Respective Counsel identified the parties who are present before this Court and also verified their signatures

The non-applicant No.2, who is present in the Court stated that as she has received one time settlement amount and articles, she has no grievance against the present applicants and willing to withdraw the criminal proceedings registered at her instance against the present applicant.

In view of the judgment, the Hon'ble Supreme Court of India in the case of Narinder Singh Vs. State of Punjab, (2014) 6 SCC 466, there is no impediment to accept the compromise in the matters, which are arising out of the matrimonial disputes. In view of this, the present application is allowed.

The offence arising out of Regular Criminal Case No.1484/2023 pending on the file of learned Judicial Magistrate First Class, Nagpur, for the offence punishable under Section 498-A read with Section 34 of the Indian Penal Code, is hereby quashed and set aside subject to costs of Rs.20,000/- to be deposited by the parties jointly to the account of "Public Welfare Account", which is operated in terms of Suo Motu Public Interest Litigation No.01/2021, within a period of two weeks.

No order as to the costs.
