The learned Counsel for Applicant has pointed out that the complaint filed by the Bank is itself not tenable, and therefore, the Applicant has moved the appropriate application before the Magistrate and the said Application is rejected. Thereafter the learned Magistrate is taking the matter on day-to-day basis.

By way of present Application, Applicant has challenged the order dated 10/2/2026 passed by the Chief Judicial Magistrate, Buldhana in SCC No. 1011/2013, whereby the learned Magistrate has rejected the application filed by the Applicant for dismissal of the complaint.

Hence, considering the peculiar facts and circumstances of the matter, issue notice to the Respondent, returnable on 24th February, 2026.

In the interregnum, there shall be stay to the proceeding bearing SCC No.1011/2013 pending before the Chief Judicial Magistrate, Buldhana till next date. 6.

In addition to regular mode of service, Applicant is permitted to serve the Respondent/Bank by all modes of private service, as permissible in Rules, and file affidavit of service on or before the next date. On failure to file affidavit of service, the stay granted in the matter will be vacated automatically. 7.

List this matter on 24th February, 2026.

It is clarified that this matter will be heard finally on the next date.
