By this Application, the Applicants are seeking quashment of proceeding bearing Regular Criminal Case No. 2223/2018 pending on the file of Judicial Magistrate First Class, Nagpur and Chargesheet No. 75/2018 dated 14/6/2018 arising out of Crime No. 7/2018 registered with Police Station, Sonegaon, District Nagpur for the offence punishable under Sections 498-A, 323, 504 read with Section 34 of Indian Penal Code. 3.
The learned Counsel appearing for Applicants submits that after registration of offence, matter is amicably settled between the parties. Accordingly, the Non-applicant No.2, who is
2/3 10.APL.317.2026.odt present in the Court, has filed affidavit-in-reply stating therein that she does not want to proceed with the present Application. The learned Counsel pointed out that the Applicant/husband and Non-applicant No.2/wife has decided to reside together and lead happy married life.

Hence, pursuant to the compromise, learned Counsel for the both sides submits that the proceeding as well as Chargesheet against the present Applicants may be quashed and set aside.

In view of the Judgment of the Hon'ble Supreme Court of India in the case of B. S. Joshi and Others V/s State of Haryana and Another, (2003) 4 Supreme Court Cases 675 there is no impediment to compromise the matter arising out of the family dispute or matrimonial dispute. Particularly when the parties have resolved their entire dispute amongst themselves. 6.
In the circumstances, compromise between the parties is accepted and the proceeding bearing Regular Criminal Case No. 2223/2018 pending on the file of Judicial Magistrate First Class, Nagpur and Chargesheet No. 75/2018 dated 14/6/2018 arising out of Crime No. 7/2018 registered with Police Station, Sonegaon, District Nagpur for the offence punishable under Sections 498-A, 323, 504 read with Section 34 of Indian Penal Code is hereby quashed and set aside.
