The applicant has filed this application for quashing the Charge-sheet arising out of the First Information Report No. 14/2023 registered for the offences punishable under Sections 323, 294, 506(2), 307 of the Indian Penal Code and Sessions Case No.201/2023 pending before the Additional Sessions Judge, Nagpur. 2.
The allegations of assault with an axe are made against the applicant, who is a relative of non-applicant No.2.

During the pendency of the trial, the matter is settled between the parties.

Both the injured are present before the Court. They have stated that the matter is amicably settled as the applicant is the first cousin of the non-applicant No.2. They do not want to proceed further.

The applicant is also present before the Court. He states that he had no intention to assaut the injured

The affidavits of the injured son and his mother are taken on record and marked as 'X' for identification. 7.
The matter is settled between the parties. Nonapplicant No.2 has no grievance against the applicant. There is no purpose in keeping the matter pending before the Trial Court. Hence, the Charge-sheet arising out of the First Information Report No.14/2023 registered for the offences punishable under Sections 323, 294, 506(2), 307 of the Indian Penal Code and Sessions Case No.201/2023 pending before the Additional Sessions Judge, Nagpur are quashed and set aside subject to depositing costs of Rs.25,000/- paid by the applicant with the Public Welfare Account maintained with Union Bank of India, High Court Branch, Civil Lines, Nagpur bearing Account No.129712010001014 and IFSC Code UBIN0812978 within a period of three weeks and producing the receipt thereof on record within two weeks thereafter.

The application is allowed in the above terms and disposed of.
