The application is for suitable directions to the learned Additional Sessions Judge, Achalpur in Criminal Revision Application No.3/2026, which is filed against the order passed by the Judicial Magistrate, First Class, Chandurbazar, Dist. Amravati.

Shri Gupta, learned counsel appearing through Video Conferencing submitted that by the order, the Judicial Magistrate, First Class has directed to hand over the cattle that i.e. three animals and one calf, which are in the custody of the applicant - Balyogi Sant Shree Mangalamata Charitable Trust to the accused nonapplicant No.2 - Mustak Kha Ibrahim Kha. He has already challenged the said order before the Additional District Judge-1 and Additional Sessions Judge, Achalpur. 3.

Despite the stay application is there, the Revisional Court has not passed any order on the said application and now, there is possibility of handing over

2 20-APL-404-2026.odt the said cattle by the police from the possession of the present applicant and then the Revision would become infructuous.

In view of that, suitable directions be given to the Revisional Court and in the meanwhile, the Judgment and order of the Judicial Magistrate, First Class, Chandurbazar be stayed.

In view of the submissions made by the learned counsel for the applicant, the record shows that on 08/02/2026 itself, the applicant has preferred a Revision, no interim orders are passed, though there is an urgency shown by the applicant that there is likelihood of transfer of the cattle to the accused.

In view of that, learned District Judge-1 and Additional Sessions Judge, Achalpur shall decide criminal revision within one month. In the meantime, the stay application shall be decided within one week. 7.

Till then, the implementation and the execution of the order passed by the Judicial Magistrate, First Class, Chandurbazar is hereby stayed.

Shri A. M. Kadukar, learned APP waives notice for non-applicant No.1-State.

With these directions, the application is disposed.
