The applicant has filed this application to quash First Information Report (FIR) No. 38/2026 registered with Sitabuldi Police Station, Nagpur for the offences punishable under Sections 340(2), 336(3), 318(4) and 316(2) of the Bharatiya Nyaya Sanhita, 2023.

FIR was lodged on 18-1-2026. It is alleged that the applicant has given assurance of transfer and taken the amount for transfer of wife of non-applicant no. 2, who is working in Maharashtra State Electricity Transmission Company Limited, from Pune to Nagpur. However, wife of complainant was not transferred and amount was not given back by the applicant, hence, complaint was lodged and crime is registered.

During pendency of this FIR, the matter is settled between the parties. Both the parties i.e. the applicant and non-applicant no. 2 (complainant) are present before the Court. I enquired with both of them. Both of them are friends and to maintain relationship, they
2 apl 441.2026 have settled the matter. The applicant has returned the amount to non-applicant no. 2.

Non-applicant no. 2 has stated that he has received the entire amount and he has no grievance against the applicant. He further submits that he has no objection to quash and set aside the FIR. He has filed affidavit to that effect. In view of the affidavit filed on record by non-applicant no. 2, the application is allowed. 5.
FIR No. (FIR) No. 38/2026 registered against the applicant with Sitabuldi Police Station, Nagpur is quashed and set aside subject to costs of Rs. 25,000/- to be paid by the applicant to the Public Welfare Account maintained with Union Bank of India, High Court Branch, Civil Lines, Nagpur bearing Account No. 129712010001014 and IFSC Code UBIN0812978 and to produce the receipt thereof on record within two weeks. 6.
The application stands disposed of.
