Rule. Rule made returnable forthwith. Heard finally by consent of the learned counsel for the parties. 2.

The applicants seek quashing of First Information Report bearing Crime No.81/2025 registered with Police Station, Wathoda, Nagpur for the offences punishable under Section 356(2), 3(5), 296, 351(2), 352, 115(2) and 85 of the Bharatiya Nyaya Sanhita, 2023. Applicant no.1 is husband of the complainant; whereas, applicant nos.2 and 3 are the mother-inlaw and father-in-law of the complainant respectively. It appears that there is marital discord between applicant no.1 and the complainant.

The First Information Report alleges that after marriage of the complainant with applicant no.1, she joined her husband at her matrimonial house. Out of the wedlock, the complainant and applicant no.1 have been blessed with two daughters. However, the First Information Report alleges that the complainant was

harassed by the applicants for various reasons including demand of dowry. It is also alleged that in the month of May 2024, the applicants ousted the complainant after quarreling. It is further alleged that the complainant was assaulted by the applicants. Therefore, on the complaint of the complainant, the aforesaid offences came to be registered against the applicants. 4.

It is submitted on behalf of the applicants as well as non-applicant no.2-complainant that the matter has been amicably resolved between the parties and the complainant is ready to cohabit with applicant no.1. The affidavit of the complainant and joint pursis which have been tendered across the bar are taken on record and marked as "X", for identification. 5.

The complainant as well as applicant no.1 are present in Court today. They have been duly identified by their respective counsels who admit the execution of the joint pursis. The dispute is matrimonial in nature and the complainant wants to lead a happy marital life with applicant no.1.

Considering the fact that the complainant does not want to prosecute the matter anymore, it will be appropriate to quash the criminal proceedings which have been initiated at the hands of the complainant vide Crime No.81/2025 and R.C.C.

No.3928/2025 subject to deposit of costs of 5,000/- by the ₹ applicants to the Public Welfare Fund, details of which are as under:

The criminal application is allowed.

First Information Report bearing Crime No.81/2025 registered with Police Station, Wathoda, Nagpur for the offences punishable under Section 356(2), 3(5), 296, 351(2), 352, 115(2) and 85 of the Bharatiya Nyaya Sanhita, 2023 and consequential proceedings bearing R.C. C. No.3928/2025 are hereby quashed and set aside subject to deposit of costs of 5000/- by the ₹ applicants to the Public Welfare Fund mentioned above. 9.

Rule is made absolute in the above terms.
