The applicants have filed this application to quash First Information Report (FIR) No. 269/2022 registered with Yashodhara Nagar Police Station, Nagpur for the offences punishable under Sections 420, 406, 465, 468 and 471 read with Section 34 of the Indian Penal Code and charge-sheet No. 98/2023 arising out of said FIR. 2.

The complainant has made allegations against his grandmother that she has executed sale deed in favour of applicant no. 1 showing that she is the only legal heir of the father of complainant. Applicant no. 1 is the purchaser and applicant nos. 2 and 3 are the witnesses to said sale deed. On complaint lodged by the complainant, crime is registered.

During the pendency of this proceedings, the matter is settled between the parties. The parties are present before the Court. The complainant has stated that the matter is settled and he has no grievance against the applicants. They have withdrawn the civil suit also. As the

2 apl 785.2026 complainant has no objection to quash and set aside the FIR and the charge-sheet against the applicants, no purpose will be served by keeping the matter pending as there are remote chances of conviction. Hence, the application is allowed.

FIR No. 269/2022 registered with Yashodhara Nagar Police Station, Nagpur against the applicants as also RCC No. 3129/2024 pending before Judicial Magistrate First Class, Motor Vehicle Court, Nagpur are quashed and set aside subject to costs of Rs. 20,000/- to be paid by the applicant no. 1 to the Public Welfare Account maintained with Union Bank of India, High Court Branch, Civil Lines, Nagpur bearing Account No. 129712010001014 and IFSC Code UBIN0812978 and to produce the receipt thereof on record within four weeks.

The application stands disposed of.
