The applicant has filed this application to set aside the order dated 19.08.2025 passed by the Sessions Court below Exh.1 transferring RCC No.67 of 2023 pending before the Additional Chief Judicial Magistrate (Court No.3), Buldhana, where Sessions Case No.3 of 2024 is pending. 2.

Learned counsel for the applicant submits that the matter pending before the Judicial Magistrate First Class arises out of a different incident and is at the stage of evidence, and therefore ought not to have been transferred.

3. On perusal of the impugned order, it appears that the incidents occurred on the same day between the same parties. Though the place of occurrence is different, the date and time are the same and the parties are identical. Kavita
