The applicant has filed this application for quashing First Information Report (FIR) No. 332/2022 and charge-sheet No. 05/2023 registered with Ganeshpeth Police Station, Nagpur for the offence punishable under Sections 376(2)(n) and 417 of the Indian Penal Code. 2.
The non-applicant no. 2 stated in the complaint that the applicant had been following her. On 29-10-2021, on the birthday of complainant, the applicant and complainant went to hotel and on the pretext of marriage, the applicant had sexual relations with her. They have repeated sexual relations. Thereafter, he refused to marry her and thus, non-applicant no. 2 lodged the complaint. 3.
During pendency of this proceedings, the matter is settled between the parties. Both the parties are present before the Court. Non-applicant no. 2 stated that she has lodged the complaint in anger. She has no grievance against the applicant and she do not want to proceed further. As the applicant is not ready to proceed further,
2 apl 898.2026 no purpose will be served by keeping the matter pending before the trial Court. Hence, the application is allowed. 4.
FIR No. 332/2022 and charge-sheet No.
05/2023 registered with Ganeshpeth Police Station, Nagpur and further the proceedings viz. Sessions Case No. 350/2024 pending before the District Judge 11 and Additional Session Judge, Nagpur are quashed and set aside subject to costs of Rs. 25,000/- to be paid by the applicant and non-applicant no. 2 separately to the Public Welfare Account maintained with Union Bank of India, High Court Branch, Civil Lines, Nagpur bearing Account No. 129712010001014 and IFSC Code UBIN0812978 and to produce the receipt thereof on record within four weeks. 5.
The application stands disposed of.
