The issue raised in this application is that the applicant has filed application for discharge and argued the matter before the Judicial Magistrate First Class (JMFC). The JMFC court heard the matter on 30-12-2025 and closed for orders. Since then, the order is not passed. 3.

Learned counsel for the applicant has relied on the judgment of this Court in the case of Pradeep K. R. Sangodker Vs. State of Maharashtra and anr. [2006 SCC OnLine Bom 838] wherein this Court has issued guidelines for the trial Court of which following guidelines are relevant.

"11(iii) In Misc. Application and/or all other matters, order shall not be delayed beyond a period of two months from the date of conclusion of arguments. (v)....

(vi) Any judicial officer, failing to comply with directions at Sr. Nos. 4 and/or 5 above shall report to the Registrar, High Court of Bombay at Goa every such matter where there is a failure with reasons for non-

Considering the guidelines and as the matter is pending for last four months, the direction is given to the learned JMFC to decide the discharge application before 8th May, 2026.
