The applicant has filed the present application seeking quashing and setting aside charge-sheet No.183 of 2024 being RCC No. 85 of 2024 and the First Information Report vide Crime no.399 of 2024 registered with Police Station Maregaon, district Yavatmal for the offence punishable under Sections 296, 115(2), 351(2) and 351(3) of the Bharatiya Nyaya Sanhita, 2023.

It is the case of the prosecution that the complainant had visited the site of construction of a road undertaken under a Government scheme for Scheduled Caste streets, extending from the house of Ramesh Nagrale to that of Ashok Barde. The said work had been in progress Kavita
2 / 2 19-apl 923-26 for about two months. During this period, the applicant is stated to have made several complaints to the higher authorities regarding the quality of the work 4.
It is alleged that the applicant abused the complainant in filthy language, assaulted her, and threatened to implicate her in a false case. It is further alleged that the applicant touched the complainant inappropriately and slapped her. When the husband of the complainant intervened, the applicant allegedly caused injury to his hand and threw a liquid from a bottle of "Roundup" on his face. Thus, serious allegations are made against the applicant.

Learned counsel for the applicant submits that the trial has already commenced and two witnesses have been examined. However, considering the nature of allegations and the contents of the First Information Report, no case is made out even to issue notice for quashing of the First Information Report and the charge-sheet.
6. Hence, the application stands rejected and disposed of.
