The applicant has filed this application for quashing of the Charge-sheet arising out of the First Information Report No.271/2025 registered for the offences punishable under Sections 69, 351(2), 351(3) of the Bharatiya Nyaya Sanhita, 2023 and Sessions Case No.18/2025 pending before the Additional Sessions Judge, Kelapur.

The non-applicant No.2 - Victim has made the allegations against this applicant that, he had sexual relations with her by giving assurance of marriage. She has lodged the complaint and the crime is registered. 3.
The learned Counsel for the applicant has stated that, the Victim is a married woman having two children. It is stated that the dispute arose out of the extra-marital affair and after it came to know to the family members, the complaint was lodged. Now the matter is settled between the parties and the non-applicant No.2 does not want to proceed further.

The non-applicant No.2 is present before the Court and is duly identified by her learned Counsel. She has stated that, she does not want to proceed further. 5.
As the matter is settled between the parties and the non-applicant No.2 does not want to proceed further, the Charge-sheet arising out of the First Information Report No.271/2025 registered for the offences punishable under Sections 69, 351(2), 351(3) of the Bharatiya Nyaya Sanhita, 2023 and Sessions Case No.18/2025 pending before the Additional Sessions Judge, Kelapur are quashed and set aside subject to depositing costs of Rs.25,000/- paid by the applicant and the non-applicant No.2 each with the Public Welfare Account maintained with Union Bank of India, High Court Branch, Civil Lines, Nagpur bearing Account No.129712010001014 and IFSC Code UBIN0812978 within a period of four weeks and producing the receipt thereof on record within two weeks thereafter.

The application is allowed in the above terms and disposed of.
